You may not access this Site if you are under 21 years of age.

thcaindex.com is an informational aggregator and marketing affiliate. The Site provides information about federally legal hemp-derived THCA products offered for sale by third-party vendors. The Service allows users to browse, search, and compare these products.

The Site DOES NOT directly sell, ship, handle, or process orders for any products. All purchases are made directly from the third-party vendor's website. We are not a party to any transaction you may make with a vendor.

Accept compensation or incentives without disclosure - you may accept payment, free products, or discounts, but you MUST disclose these in your review text
Submit AI-generated reviews without disclosure - you may use AI assistance but must clearly indicate this in your review
Post reviews for vendors you have not endorsed on your landing page
Include spam, promotional content, or unauthorized affiliate links in your reviews
Defame, harass, or make false statements about vendors, products, or other users
Copy or plagiarize reviews from other websites or users
Upload images you don't have rights to use, including vendor marketing images without permission
Manipulate or game the review system to artificially inflate or deflate ratings

⚠️ Enforcement: Violation of these review policies may result in immediate account suspension, removal of all reviews, and termination of affiliate commissions without warning.

6. Intellectual Property & Content Ownership

6.1. My Original Content

I am the owner of all original content created for thcaindex.com. This includes the website's design, layout, logos, my original written text (like articles or guides), and the way I have organized the product data. This original content is protected by copyright law, and you may not use it without my direct written permission.

6.2. Third-Party Product Content

9. Matrix Chat Service (chat.thcaindex.com)

9.1. Service Description

We operate an unfederated Matrix chat server at chat.thcaindex.com. This server does not connect to or federate with other Matrix servers. Your communications remain within our isolated server environment.

9.2. No Service Guarantees

Service provided "AS IS" without warranties of any kind
No uptime guarantees - service may be unavailable without notice
Service may be terminated at any time without prior notice
No liability for data loss or failed message delivery
Use at your own risk - we disclaim all liability for service interruptions

9.3. Account Requirements and Rules

One account per person - multiple accounts are prohibited
Age requirement: Must be 21 years or older to create an account
Account security: You are responsible for maintaining account security
Username policy: Usernames cannot be changed once created

9.4. Prohibited Content and Conduct

The following are strictly prohibited on our Matrix chat service:

Illegal content of any kind
Harassment, threats, or doxxing of any user
Malware or hacking attempts against the service or users
Spam or unsolicited promotional content

10. User-Generated Content - Product Reviews

10.1. Overview

THCAIndex allows registered users to submit product reviews, including text, ratings, images, and video embeds ("User Content"). By submitting User Content, you agree to the terms in this section.

10.2. Content Ownership and License Grant

You retain ownership of any User Content you submit. However, by submitting User Content to THCAIndex, you grant us a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

Use, reproduce, modify, adapt, and publish your User Content
Display your User Content on the Site and in promotional materials
Create derivative works from your User Content
Distribute your User Content through any media channels
Sublicense these rights to third parties (such as affiliate vendor partners)

This license continues even if you delete your account or remove your User Content, as we may have already distributed or used it in ways that cannot be undone.

10.3. Image Rights and Licenses

By uploading images as part of your review, you represent and warrant that:

You own the images or have obtained all necessary rights and permissions
The images do not infringe any third-party intellectual property rights
You have the right to grant the license described in Section 10.2
If the images contain identifiable people, you have obtained their consent

We will process, resize, and convert uploaded images to optimize them for web display (WebP format). You agree that we may modify images as necessary for technical or display purposes.

10.4. Review Authenticity and FTC Compliance

IMPORTANT - FTC DISCLOSURE REQUIREMENTS:

You may only review products from vendors you have "endorsed" (curated) on your landing page
Reviews for endorsed vendors may result in affiliate commissions if readers make purchases
You must have actually purchased and used the product you are reviewing
Your reviews must reflect your honest opinions and genuine experiences
Incentivized and paid reviews are permitted but you MUST clearly disclose in your review text:
- If you received the product for free or at a discount in exchange for a review
- If you received payment or other compensation from the vendor for the review
- Any material connection with the vendor beyond our standard affiliate program
Disclosure must be clear and conspicuous - use plain language like "I received this product for free" or "The vendor paid me to review this"
Fake reviews for products you haven't actually used are strictly prohibited

By submitting a review, you represent that you have complied with the FTC's Endorsement Guides and all applicable advertising laws.

10.5. Prohibited Review Content

Your User Content must not contain:

Defamatory or false statements about vendors, products, or other users
Spam, promotional content, or affiliate links (other than to vendors in our system)
Illegal content or content encouraging illegal activity
Obscene, pornographic, or excessively violent content
Personal information of others (addresses, phone numbers, emails)
Copyrighted material you don't have rights to use
Malicious code, viruses, or harmful software
Harassment, threats, or hate speech
Reviews for products you haven't used or fake reviews
Coordinated or incentivized reviews arranged with vendors
AI-generated content without clear disclosure

10.6. Content Moderation and Approval

All reviews require admin approval before being published. We reserve the right to:

Review, approve, reject, or remove any User Content at any time, with or without notice
Edit or modify User Content for formatting, length, or clarity (substantive content will not be altered)
Remove User Content that violates these Terms or applicable law
Suspend or terminate accounts that repeatedly violate content policies
Disable comments or reviews for specific products or vendors

We are not obligated to monitor User Content but reserve the right to do so. Approval of User Content does not constitute endorsement of its accuracy or opinions.

10.7. Compensation and Disclosure

THCAIndex does not pay you for reviews. However, you may:

Earn affiliate commissions when readers purchase from your endorsed vendors
Accept compensation, free products, or discounts from vendors in exchange for reviews

If you receive anything beyond standard affiliate commissions, you MUST disclose this clearly in your review. Failure to disclose material connections violates FTC regulations and these Terms.

10.8. Removal and Deletion

You may delete your own reviews at any time through your account dashboard. However:

Deletion removes the review from public display but does not revoke the license granted in Section 10.2
Cached or archived copies may persist temporarily
We may retain copies for legal compliance and record-keeping purposes
If your review has been shared or distributed, we cannot recall those copies

10.9. User Representations and Warranties for Reviews

By submitting User Content, you represent and warrant that:

You have actually purchased and used the product you are reviewing
Your review reflects your honest opinion and genuine experience
Your User Content is accurate to the best of your knowledge
Your User Content does not violate any laws or these Terms
Your User Content does not infringe any third-party rights (copyright, trademark, privacy, etc.)
You have all necessary rights to grant the license in Section 10.2
If you received compensation, free products, or anything of value beyond standard affiliate commissions, you have clearly disclosed this in your review
You have complied with all FTC disclosure requirements and advertising laws

10.10. Liability for User Content

YOU ARE SOLELY RESPONSIBLE FOR YOUR USER CONTENT. THCAIndex is not responsible for:

The accuracy, quality, or legality of User Content
Any claims arising from your User Content
Any damages resulting from your use of the review system

You agree to indemnify and hold harmless THCAIndex from any claims, damages, or expenses arising from your User Content or violation of this Section 10.

10.11. DMCA and Copyright Claims for User Content

If you believe User Content infringes your copyright, follow the procedure in Section 6.3 to submit a takedown notice. We will investigate and remove infringing content as required by the Digital Millennium Copyright Act (DMCA).

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on the Site and updating the "Last Updated" date.
